      3. the name, photograph or likeness, copyrighted materials, or property of individuals associated with DNAHUB, without express written authorization from the individual concerned and/or DNAHUB.

4. USER REPRESENTATIONS

   1. By accessing this TOS, you agree to, acknowledge, and represent as follows:

      1. that you are aware that this site is a business and commercial site, and therefore this site is not intended for persons under the age of eighteen (18). If you are under the age of eighteen (18), you require your parent's or guardian's or responsible adult's permission before accessing this site and you shall be deemed to have obtained such permission by continuing to accessing this site;

      2. you are eighteen (18) years of age or older, and are capable of entering into a legally binding contract/agreement with DNAHUB;

         3. sponsors and upline business leaders who may need access to downline distributor personal information in order to monitor sales activity and business development in their personal sales groups. However, DNAHUB does not share credit card information or social security or social insurance numbers with any third party without your permission or unless otherwise required by law or valid court order; and

         4. persons or organizations seeking references to participate in DNAHUB's distribution.

   2. You acknowledge that you are entitled to submit a request and to obtain from DNAHUB regarding your personal information or the type of personal information held by DNAHUB and to update or amend any data that is inaccurate (unless an exception applies). Any request made by you must be in writing and must be signed.

You hereby irrevocably agree that DNAHUB reserves the right, in its sole discretion, to use and utilise any database information, documents and materials which have been voluntarily provided by you, to use and utilize testimonial (or other statements about DNAHUB, the Products in printed or recorded form, including translations, paraphrases, and electronic reproductions of the same), and image or likeness (as produced or recorded in photographic, digital, electronic, video, or film media) in connection with advertising, promoting, and publicizing DNAHUB's opportunity, products, or any related or sponsored events of DNAHUB or statistical purposes. Notwithstanding the foregoing, you may revoke or terminate this authorisation at any time by giving written notice to DNAHUB and such revocation or termination of the authorisation shall not be applicable to earlier publications, promotions or advertisements done by DNAHUB prior to the revocation taking place.

DNAHUB cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

   8. You acknowledge that DNAHUB reserves the right in its sole discretion to refuse, limit or terminate access to the use of the website by you at any time. Further, DNAHUB may terminate the access of your account (or any other part thereof) or restrict the use of the service and/or remove and/or discard any content therein, for any reason as DNAHUB in its sole discretion deems fit, due to reasons including but not limited to the lack of usage of the account by you or in the event you violate, breach or evidence an intention to violate or breach any of your obligations, stipulations, terms, conditions and/or undertakings herein. In the event such an account closure is initiated by DNAHUB for any reason, DNAHUB will provide thirty (30) calendar days� prior notice to you and may suspend access to your account.    9. You are entitled to discontinue from using service at any time without giving notice to DNAHUB save and except when you request DNAHUB to delete your Personal Information.    3. DNAHUB makes no representations or warranties regarding the efficacy of the Products as the individual results may vary.    6. Prior to using Products of DNAHUB, you shall consult your healthcare provider, especially if you are pregnant, nursing, taking medication or have a medical condition. Any reliance on or use of the Products is at your own risk.

   7. Save and except the information, warranty and representation(s) stipulated herein and at the Website, DNAHUB assumes no responsibility and liability for any dispute(s) or claim(s) between the distributor(s) and their customer(s).

6. ORDERING POLICIES, PRODUCT GUARANTEES AND RETURNS

   1. You agree to place orders for the Products only from the Platform (hereinafter referred to as "the Order"). You are not allowed to place order through other means, such as by dealing personally and directly with any distributor.

   2. In the event you are placing Order through the Platform, such payment shall be made directly to DNAHUB, of which the method of payment can be by way of debit card, credit card (VISA or MasterCard) or online banking or any other modes of payment as agreed by DNAHUB. You hereby agree to pay for any applicable service and administrative fees (if any) chargeable for any payment made other than by way of cash. You further acknowledge that in the event you use a third party’s bank card to make payment, you must have sought the express and written permission of the third party prior to making payment. You acknowledge that using a third party’s bank card without the express and the written permission of the third party concerned is prohibited and you may further subject to legal proceedings under applicable laws and regulations.

   3. In the event any Order which has been placed but with invalid, declined or incorrect payment, DNAHUB will attempt to contact the person, either by telephone and/or mail, in order to obtain the necessary payment for the order placed. If these attempts are unsuccessful after five (5) working days, the status of the Order will become “unprocessed” and the Order will not be accepted by DNAHUB. No order via cash on delivery (C.O.D) payment will be accepted.

   4. DNAHUB endeavors to process the Order with successful payment received within three (3) business days after the Order has been duly received by DNAHUB. Once DNAHUB has processed the Order, DNAHUB will endeavor to arrange for the delivery of the Order within five (5) to seven (7) business days therefrom. Notwithstanding the foregoing, you hereby acknowledge that any dates quoted by DNAHUB for delivery of the Orders are approximate only and delays may occur which are beyond the control of DNAHUB. The time for delivery shall not be of the essence and DNAHUB shall not be liable for any delay in delivery howsoever caused, including but not limited to any delay caused by an incorrect delivery address provided to DNAHUB and/or any changes made to the Order by you. Additionally, DNAHUB shall not be held liable for any damage caused by the logistic during delivery.

   5. Under special circumstances and subject always to DNAHUB’s prior approval, you shall only entitle to pick up your order at DNAHUB office before any delivery is arranged by DNAHUB. In the event you have opted to pick up the order, but the order has not been picked up within ten (10) working days following the purchase or following the Order date, DNAHUB shall have the absolute right to proceed to arrange to deliver the order to the main address registered in your account and the relevant applicable shipping charges will be borne solely by you. If the said incident occurs three (3) times consecutively or cumulatively, then DNAHUB will no longer accept any “pick-up” orders from you. In such an event, any order placed by you subsequently will automatically be delivered and the applicable shipping charges will be borne solely by you.

   6. You acknowledge that once the Order has been placed, the Order shall not in any way be modified or cancelled after submission thereof save and except with the prior consent of DNAHUB in writing having been obtained. You acknowledge that after the prior consent of DNAHUB has been obtained, you shall, at your own cost and expense, indemnify in full against all loss (including loss of profit), costs (including the cost of all labor and materials used), damages, charges and/or expenses incurred by DNAHUB because of the modification or cancellation, as the case may be.

   7. You acknowledge that the price of the Products varies according to different countries. Further, the specific price of a product or any part thereof varies accordingly to the shipping address of the recipient which would be displayed automatically upon check out.

   8. Products Non-Returnable

      1. Notwithstanding these TOS, you hereby agree that there are situations where the Products cannot be returned to DNAHUB and DNAHUB will not guarantee the authenticity, quality of the Products or accept complaints about product related issues, namely:

         1. Products that have been intentionally damaged or misused;

         2. Products which are of limited editions, promotional and/or seasonal, Products which have expired or are no longer available or which are given as freebies or complementary through events/ programs;

         3. Products which are purchased not through DNAHUB Website, but through unauthorized distributors/sellers/any other third party, including but not limited to purchase through any other online platforms or retail shops. DNAHUB shall not be held liable and will not guarantee the authenticity, quality of the Products or accept any complaints made about Products purchased through aforesaid means; and

         4. Products which have been purchased from unauthorised sellers (online platforms or retail shops).

   9. Return Policy:

      1. Satisfaction Guarantee - Subject to clause 6.8.1, the Company warrants the quality of the Products and shall exchange or refund any defective product. For avoidance of doubt, the distributor(s) shall be entitled to apply for exchange or refund whereas VIP member(s) and/or consumers, shall only eligible for product exchange and there will be no refund.

      2. In the event the distributor(s), VIP member(s) and/or member(s) receives a product which is defective, damaged and/or faulty (not caused by the negligent of the logistic during course of delivery), different product delivered, has air leakage, has foreign objects in it and/or does not match the agreed specification or quantity as stipulated in the Order, the distributor(s), VIP member(s) and/or member(s) must complete and submit the cancelling Distributor Product Exchange/Return Form or Refund Form, as the case may be, in order to facilitate the request for exchange or refund, for full credit on the returned product for the purchase of another product, or for a refund of the purchase price of the product, as the case may be, to DNAHUB in writing (care@dnahub.world) / contact the Customer Service Careline at +60386901166 on business days [between 10am and 6pm] within sixty (60) calendar days from the actual delivery date of the said product (online purchase)/ from the date of purchase (at shop). DNAHUB reserves the right not to process any application submitted beyond the stipulated period of time. Upon receipt of the DNAHUB’s approval of the said request, the distributor(s), VIP member(s) and/or member(s) shall proceed to submit a Returned Merchandise Authorisation Form (if applicable) or Refund Form (if applicable, as the case may be, while returning the Products to DNAHUB in new, sealed and unused condition and in its original packaging and in good sellable condition. The aforesaid defective product must be sent to DNAHUB within ten (10) days. Any cost and expense incurred on returning the Products and delivery of exchanged the Products to the Distributor shall be solely borne by the distributor(s), VIP member(s) and/or member(s).

      3. Notwithstanding the above provisions, any return is only accepted by DNAHUB if the Product is in its original and sealed packaging, unused and in good sellable condition as well as if there is no outstanding payment instalment on that Product.

      4. DNAHUB reserves the right, in its sole discretion, to approve or reject a return Products based on its current returns policy.

      5. Any returns based on reactions derived from Product’s consumption are handled on a case-by-case basis. Actual products may vary slightly from products shown in DNAHUB’s Product Catalogue due to the print production process.

      6. Failure to notify DNAHUB of any shipping discrepancy or damage (not caused by the negligent of the logistic during course of delivery) within thirty (30) days of shipment will cancel your right to request a correction.
